The following discloses the terms and conditions of use and privacy notice concerning the Blair Academy website, www.blair.edu (“website”). 

This Terms and Conditions of Use Agreement (“Terms and Conditions” and/or “Agreement”) sets forth the terms and conditions applicable to your access and use of the Blair Academy Website, www.blair.edu (“website”).  You and all visitors to the website, including students, faculty, staff, alumni, donors and members of the public (hereinafter “visitor” and “visitors”) accept this Agreement by using the website or accessing any content available through the website.  Blair Academy (“Blair” and/or “School”) may revise this Agreement at any time by posting the revised Terms and Conditions on the website, and you agree that your use of the website after such changes are posted will constitute your acceptance of them.

Blair Academy respects the privacy of all who visit its Website at www.blair.edu, subscribe to Blair e-newsletters, submit forms and/or contribute to the School financially, through volunteer service or by sharing information. By using the website or accessing any content available through the website, you accept the terms of this Privacy Notice set forth herein. Blair may revise this Privacy Notice at any time by posting the revised Privacy Notice on the website, and you agree that your use of the website after such changes are posted will constitute your acceptance of them.

Information Collection & Use

It is essential and necessary for Blair to collect, process, use, and/or maintain the personal information of visitors to the website, including students, faculty, staff, alumni, donors and members of the public (“visitor” and “visitors”) to ensure the functionality of the website and to achieve its educational mission.  

Personal Information Collected

Through its website, Blair collects personal contact information from a visitor when that visitor voluntarily submits such information. For example, if a visitor uses the website to request information for a particular program or activity, signs up for a mailing list, requests access to a protected portion of the website, submits a form or makes a payment, that visitor’s personal information will be collected. When a visitor submits forms or requests access to a protected portion of the website, Blair also collects information about that visitor’s use of the website through cookies and server logs, which track the IP addresses of those who visit the website and the pages they visit.

Your personal information will never be sold, leased, rented or otherwise disclosed in any manner to any outside entity without your prior consent unless otherwise required by law or as may be necessary as part of regulatory compliance. For students, parents and employees, your information in the website’s portals is password protected and available only to authenticated users. Visitors who wish to opt out of our online directory may do so by updating their profile accordingly within those portals. 

Information Gathered Automatically

When a visitor visits the website or requests access to a protected portion of the website, Blair may automatically collect and store certain digital information sent by the visitor’s web browser, such as the visitor’s IP address, geolocation, the web browser used, the device operating system and other information, such as the pages visited, the length of time spent on each page, and any terms searched. Additionally, as stated above, when a visitor submits a form or requests access to a protected portion of the website, Blair may store the visitor’s IP address as well as the information submitted through the form. 

How Long Do We Keep Your Information?

Blair generally keeps your personal information submitted or gathered through your use of the Website for as long as needed to operate the Website in an efficient manner and for any other legitimate use by it.  Blair also retains your personal information as necessary to comply with legal, accounting, and regulatory requirements.

Blair Academy strictly prohibits the use, reproduction, redistribution, alteration and/or exploitation of its photos/images for commercial purposes without the express prior written permission from the Communications Department. Although photos/images published by the School on Photoshelter.com may be used non-commercially without requesting permission, the use of any photo, image or graphic from the Blair archives or the School’s official, non-public collection must be pre-approved.

Requests related to photos, images and/or graphics in Blair’s private digital archive and any photos, images and/or graphics published on Blair’s website should be directed to Director of Communications Adele Starrs at starra@blair.edu. Requests related to historic images that are part of Blair’s archives can also be sent to Ms. Starrs, who will coordinate with Timken Library staff as appropriate. The School reserves the right to deny any photo use request for any reason, and archival images will be watermarked until approval for commercial or non-commercial use is granted.

All approved uses of Blair photos, images, or graphics, including those downloaded from Photoshelter.com, should include the credit: “Photo or graphic courtesy of Blair Academy.”

The website and any text, images, videos, documents and any other electronic materials and media available on the website are the sole property of Blair Academy and are copyrighted materials protected by domestic and international copyright laws. As such, the reproduction, duplication, copying, selling, reselling, redistribution, alteration and/or exploitation of any of these materials is strictly prohibited without the express prior written permission of Blair Academy. Similarly, the Blair Academy logos and seals are copyrighted materials protected under copyright law, as well as trademark law; thus, they shall not be used for any purpose without Blair’s express prior written permission.

The name, Blair Academy, is a federally registered trademark owned by Blair Academy that shall not be used for any commercial or source-identifying (i.e., trademark) purposes. Additionally, the Blair Academy logos and seals are federally registered trademarks and/or protected under common law trademark law; thus, they shall not be used for any purpose whatsoever without Blair’s express prior written permission.

By accessing and using this website, you agree that all content and password-protected data, particularly any student or parent contact information or other information contained in the directories of the website, is restricted to your personal use and the personal use of other authorized visitors only. The commercial use of information found on the website is strictly prohibited. Additionally, you shall not copy, post, email or otherwise transmit any unsolicited or unauthorized advertising or promotional materials through the website. Blair reserves the right to limit, restrict, suspend or terminate any individual's or entity's access to and use of the password-protected portions of the website at any time, with or without advance notice.

Disclaimers & Limitations of Liability

The website and all content on the website are provided to visitors on an “as is” and “as available” basis without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Blair makes no warranty as to the accuracy, completeness or reliability of any content available through the website. You are responsible for verifying any information before relying on it. Use of the website and the content available on it is at your sole risk. Visitors are responsible for taking all necessary precautions to ensure that any content they may obtain from the website is free of viruses or other harmful code.

To the maximum extent permitted by applicable law, Blair disclaims all liability, whether based in contract, tort, strict liability or otherwise, and further disclaims all losses, including without limitation indirect, incidental, consequential or special damages arising out of or in any way connected with access to or use of the website, the content or the goods/services offered through the website, even if Blair has been advised of the possibility of such damages. 

Indemnity

You agree to indemnify, defend and hold Blair and its subsidiaries, affiliates and their respective officers, agents, members, partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorneys’ fees, due to or arising from your use of the website and/or breach of this Agreement.

Governing Law & Injunctive Relief

By accessing this website, you consent that Blair Academy may pursue injunctive relief in court in the event that it considers you to have violated any of the terms or policies set forth in these Terms and Conditions or the Privacy Notice. You further agree that jurisdiction shall lie in the Superior Court of Warren County, New Jersey, or any applicable federal court in New Jersey should any dispute between you and Blair concerning any of the terms set forth in these Terms and Conditions or the Privacy Notice arise. Blair reserves the right to seek all remedies available at law and equity for violations of this Agreement, including the right to block any visitor’s access to the website.

Miscellaneous

• If any provision of this Agreement is held to be illegal, invalid or unenforceable, such provision shall be struck, and the remaining provisions shall remain in full force.
• Headings are only for reference purposes and in no way define, limit, construe or describe the scope or extent of such section.
• Blair’s failure to act with respect to any failure by you to comply with these Terms and Conditions does not waive Blair’s right to act with respect to subsequent or similar failures.
• These Terms and Conditions set forth the entire understanding between you and Blair concerning the subject matter at hand.
• You may not assign or transfer your rights or obligations under this Agreement without the prior written consent of Blair. Any assignment or transfers of rights or obligations under this Agreement shall be null and void.

In order to customize your experience while on the Website, Blair uses cookies, which are small text files placed on your device to gauge usage patterns and remember information about you and your device. Cookies are used to manage your browsing session on the website (e.g., to keep you “logged in” as you move from page to page if you have logged in).Cookies may also be used for the purpose of tracking page visits and other aggregate site statistics and to ensure the safety and security of the network. Cookies may be used to help diagnose any problems with the School’s servers as well. These cookies do not contain any identifiable personal information and are only used to improve the functionality of the website and your experience while on the website.
